Description: My sister in law and myself have been bickering when she came to visit, she had upset me so she was not invited to my home. She was in my home for 5 mins only. She was uninvited to my daughter's 6th birthday. She arrived home and kept bickering with me online. My husband, her brother, was in between and told her if she didn't leave me alone I would be contacting her employment. I never did. She then threatened me online and then called CPS and made false statements. They came to my home and Interrigated my children, checked them, house, food, beds. My husband contacted his sister and she admitted to calling and said " Tell her if she wants to play it this way then I will." CPS said the allegations were that we had a 1 yr old crawling in garbage, roaches and rats. She is the Aunt, she knows their ages. We do not have a 1 yr old. We do not have roaches, we do not have rats. I feel victimized. Not only do I want to sue the sister in law for the false claim, but CPS for not changing their policy on taking false reports. Just the fact that she claimed to see a problem on 6-20 and then did not call until I made her upset on 6-25. She did not visit my home but for a few minutes, then left because her brother was not home. She does not even live in CA, but in Utah and does not visit but once every 2-3 years. I have not slept, I have not been eating, I am upset and sick from this ordeal. CPS left and did not see cause to remove my children, but I feel terrorized. I now live with fear that if I make someone upset they can use this to hurt me because CPS believes anything. And does not screen calls to find lies and vindictiveness in them. I need help. All I have is her admission to her brother that she did it to get back at me.

thats bullshit! I JUST WENT THROUGH A YEAR OF SHEAR TORTURE WORRY AND PAIN BECAUSE I WAS BEING TOLD THEY WERE TAKING MY SON AWAY FOR A BRUISE HE GOT WHEN I WASNT HOME AND HE WAS AT MY NEIGHBORS! I just recently won but I spent 30,000 to get justice and now I am trying to make sure that spiteful lying vengeful pitiful human being for a cps agent answers to me and what she did to my family!! there is a site to go to that is SOOOO HELPFUL because its too sickingly common go to fightcps.com

I have a similar case and am sick to my stomach about the horrible feeling when I was told by my child he was interviewed at school by a CPS based on false reports. I would like to sue also. Have you found a good lawyer? Thank you.

There is a reason why they don't punish false reports: they don't want to discourage people from calling for fear that they might be prosecuted. However, CPS does a pretty good job of investigating before they take action. That's why they came out to check. If you do nothing wrong, you have nothing to worry about. All state enforcement agencies have similar policies for anonymous reports. While it causes inconvenience to some, it removes barriers to reports of real violations and protect children who are in danger. You may consider taking out a restraining order against your sister-in-law to document the incident. If she violates the order, you can easily get her prosecuted.
